“Trade mark” means a mark capable of being represented graphically and which is capable of distinguishing the goods or services of one person from those of others and may include a device, brand, heading, label, ticket, name, word, letter, numeral, shape of goods, packaging or combination of colors or any combination thereof

Registering your trademark gives you the exclusive right to use your mark for the goods and/or services.

If you have a registered trademark you can put the ® symbol next to it to warn others against using it. But, using this symbol for a trademark that is not registered is an offence.
